New rule: From March 22, composite wood products must be labeled TSCA Title VI!

Last May, the Northern District Court of California issued a decree to advance the effective date of EPA TSCA Title VI to June 1, 2018.

I. Compliance Date of Relevant Changes:

 

 From June 1, 2018, composite wood products and finished products containing composite wood products ( when manufactured or exported to the United States ) must be certified by a third-party certification authority ( TPC ) approved by CARB and EPA to prove that they meet TSCA Title VI or the same level of California Air Resources Commission ( CARB)ATCM P2 release standards.  ( Note: The original effective date is December 12, 2018 )

 

 From June 1, 2018 to March 22, 2019, composite wood products certified to meet formaldehyde emission standards must be labeled as meeting TSCA Title VI or CARB ATCM P2 release standards.

 

 After March 22, 2019, products must be certified and labeled TSCA Title VI.

 

 The following compliance dates have not changed ( final regulations issued by EPA on September 25, 2017 ):

 

 The compliance period for import certification will be extended from December 12, 2018 to March 22, 2019.

 

 The compliance period for laminate manufacturers will be extended from December 12, 2023 to March 22, 2024.

TSCA ( Toxic Substances Control Act ) is an important regulation for the management of industrial chemicals in the United States. It aims to comprehensively consider the environmental, economic and social impacts of chemicals circulating in the United States and prevent " unreasonable risks" to human health and the environment.  The US Environmental Protection Agency ( EPA ) is responsible for implementing TSCA's control of chemicals, while the US Customs and Border Protection Agency ( CBP ) is responsible for inspecting the import of chemicals under TSCA regulations.
